I ascertain and acknowledge that I either own or have exclusive rights and licenses to all pictures and written materials  that I upload on AwkwardSchoolPictures.com and I authorize AwkwardSchoolPictures.com and its owners, affiliates, sponsors etc to publish, edit and reproduce all materials uploaded to them. I also agree that AwkwardSchoolPictures.com has no liability to me and that I understand that I cannot seek monetary compensation for submissions. I also acknowledge that I have the written consent, and permission of each identifiable person in the picture and that each person also accepts that AwkwardSchoolPictures.com will use the submissions in a manner set forth by the websites owners.

I the submitter also grant AwkwardSchoolPictures.com a worldwide, royalty free license and permission to use the photos and written materials submitted to them either by email or through the submission page, and I grant them permission to reproduce, edit distribute, broadcast and print all materials submitted to them in their entirety or in part on the AwkwardSchoolPictures.com website or in other forms such as books, calendars, bumper stickers, clothing, mugs, etc.
I agree that I will not submit anything that is copyrighted, trademarked or in any way does not belong to me, unless I am the owner or have permission from the owner to submit all materials. As the submitter of a picture I acknowledge that I am the father, mother, or guardian of all minors that appear in materials submitted to AwkwardSchoolPictures.com and grant permission and understand that submitting material to AwkwardSchoolPictures.com does not guarantee that it will be published on the website or used for other promotional purposes related to AwkwardSchoolPictures.com.
I agree to remunerate AwkwardSchoolPictures.com and defend its owners, affiliates, sponsors etc, even where costs, damages, liabilities, penalties, judgments or any other setbacks are incurred due to my breach of the agreements set forth in this Terms and Conditions page regarding the statement that I am the rightful owner of all submissions or have permission from its rightful owner to submit for posting on AwkwardSchoolPictures.com and for use in all other promotional purposes mentioned above; and the statement that I have permission from all third parties to post submit materials and have the authority to submit material depicting minors.

This Agreement, the Privacy Policy and any other agreement between you and AwkwardSchoolPictures.com and its owners shall be governed by and construed in accordance with the laws of the State of California, United States of America, excluding its conflicts of law rules. In the event of any dispute arising out of or in connection with your use of the Site or the Services, such dispute shall be submitted to arbitration in the County of San Diego, State of California, United States of America in accordance with the rules and regulations of the American Arbitration Association then in effect (as amended herein), provided that said arbitration shall be heard before a single arbitrator, selected pursuant to such rules and regulations, and shall be conducted on an expedited basis and in confidence. Each party hereby waives any and all rights and benefits which it might otherwise have or be entitled to under United States federal law or the laws of the State of California, United States of America or any other state or country to litigate any such dispute in court, it being the intention of the parties to arbitrate, according to the provisions of this Agreement, all such disputes. The arbitrator’s decision shall be controlled by the terms and conditions of this Agreement and any other agreements you may enter into with AwkwardSchoolPictures.com, and shall be final and binding, and shall provide for each party to bear its own costs of arbitration and attorneys’ fees. Each party expressly waives any right to a jury. Judgment upon the award of the arbitrator may be entered or enforced in any court of competent jurisdiction. If either party shall fail to appear at the hearing on the date designated in accordance with the rules of the American Arbitration Association, or shall otherwise fail to participate in the arbitration proceeding, the arbitrator is hereby empowered to proceed ex parte. In the event of any dispute concerning this Agreement or any other agreement between you and AwkwardSchoolPictures.com, your sole and exclusive remedy shall be to seek damages pursuant to an arbitration authorized herein, and in no event will you be entitled to seek rescission, or injunctive or other equitable relief. If you do not agree to these requirements (or any other provision herein), do not use the Site or the Services.
